Event Disclaimer & Liability Notice

This Event Disclaimer & Liability Notice ("Disclaimer") applies to Rivers & Roots Festival ("R&R Fest"), produced and presented by Privia Group, LLC ("Privia," "we," "us," or "our"). "Rivers & Roots" is a trademark owned by Privia Group, LLC.

By attending, participating in, or being present at R&R Fest or any related activities, you acknowledge and agree to the terms of this Disclaimer.

Hmong American Partnership (HAP) serves as fiscal agent for a grant supporting this project. HAP is not responsible for event operations, safety, liability, or any obligations described in this Disclaimer.

1. Assumption of Risk

R&R Fest is a live, public, all-ages event that may involve large crowds, music, performances, food and beverage service, alcohol service by licensed vendors, and dynamic environmental conditions.

By attending, you voluntarily assume all risks, known and unknown, including but not limited to:

  • crowd density and movement;

  • slips, trips, and falls;

  • noise levels and lighting effects;

  • weather and environmental exposure;

  • interactions with other attendees, vendors, or performers;

  • food consumption, including allergens and dietary sensitivities; and

  • travel to and from the Event.

2. Release of Liability

To the fullest extent permitted by law, you hereby release, waive, and discharge Privia Group, LLC and its affiliates, officers, directors, employees, contractors, agents, sponsors, and partners from any and all claims, liabilities, damages, losses, or expenses arising out of or related to:

  • your attendance at or participation in the Event;

  • the acts or omissions of third parties, including vendors and other attendees; or

  • any conditions, risks, or hazards associated with the Event.

3. Alcohol and Food Disclaimer

Alcohol, if available, is served exclusively by licensed third-party vendors. Privia Group, LLC does not manufacture, distribute, or directly serve alcohol.

You acknowledge that:

  • consumption of alcohol is at your own risk;

  • you are responsible for complying with all applicable laws and regulations; and

  • Privia Group, LLC is not liable for any injury, damage, or incident arising from alcohol consumption.

Food vendors are independent operators. Privia Group, LLC does not guarantee food safety and is not responsible for allergic reactions, foodborne illness, or dietary issues.

4. Third-Party Vendors and Activities

R&R Fest may include independent vendors, performers, sponsors, and service providers.

These third parties operate independently and are solely responsible for their:

  • products and services;

  • staffing and operations; and

  • compliance with applicable laws and regulations.

Privia Group, LLC is not responsible for third-party conduct, products, or services.

5. Medical and Emergency Disclaimer

You are responsible for your own health, safety, and well-being while attending the Event.

Privia Group, LLC does not provide medical services and is not responsible for:

  • medical treatment;

  • emergency response outcomes; or

  • health-related incidents occurring at or near the Event.

In the event of an emergency, you should contact appropriate emergency services.

6. Media and Recording Notice

R&R Fest is a recorded event environment.

By attending, you acknowledge that:

  • photography, audio, and video recording may occur; and

  • your image, likeness, voice, and statements may be captured.

You grant Privia Group, LLC a perpetual, worldwide, irrevocable, royalty-free right to use such materials for promotional, commercial, editorial, and other lawful purposes.

7. Event Changes and Force Majeure

Privia Group, LLC reserves the right to modify, postpone, or cancel the Event, in whole or in part, at any time.

We are not liable for delays, interruptions, or cancellations due to circumstances beyond our control, including but not limited to:

  • weather conditions;

  • public health concerns;

  • acts of government;

  • venue issues;

  • supply chain disruptions; or

  • other force majeure events.

8. Code of Conduct

All attendees are expected to behave in a respectful and lawful manner.

Privia Group, LLC reserves the right to remove any individual from the Event without refund for behavior that is unsafe, disruptive, unlawful, or inconsistent with event policies.

9. Limitation of Liability

To the fullest extent permitted by law, Privia Group, LLC shall not be liable for any:

  • indirect, incidental, consequential, or punitive damages;

  • loss of property, data, or personal belongings; or

  • damages arising from third-party services or interactions.

10. Minnesota Humanities Center / Legacy Acknowledgment

This work is funded in part by the Minnesota Humanities Center with money from the Arts and Cultural Heritage Fund, as appropriated by the Minnesota State Legislature from the Minnesota Clean Water, Land & Legacy Amendment, created by the vote of the people of Minnesota on November 4, 2008. Funding for this project was originally awarded under the project title “Sabaidee Cultural Festival.” Hmong American Partnership (HAP) serves as the fiscal agent for this grant.
